MYTUTORING101 SERVICES CONTRACT
I. THE PARTIES
This is a legally binding document (“Agreement”) dated ____________ (“Effective Date”), between the following: MY TUTORING 101, owned and directed by Ana E. Yacobian, located at 1916 Zenaida Ave., McAllen, TX 78504, and (Client): ______________________________, a legal resident of the city of ______________________________ in the state of Texas. Client and Tutor are each referred to herein as a “Party” and, collectively, as the “Parties,” agree to the following:
II. STUDENT
The Client is the legal guardian of __________________________ and will make the payments for the services on behalf of the student.
III. SERVICES
The Tutor agrees to provide tutoring services to the student in the following subject areas: Phonological Awareness, Phonics, Reading, Language Arts, Mathematics K-8th, Spanish, Test preparation, Homework help.

IV. LOCATION
Tutoring will take place:
In Person: Tutoring sessions will take place in person, and the Student and the Tutor will meet at the following location: 1916 Zenaida Ave., McAllen, Texas 78504, or at the Client/Student home at ________________________________________________________. Additional charges of $20 dollars are added for providing services at the client/student's home.
Remotely: The Tutor will arrange for a video conference at the scheduled time and will provide the student with an emailed link to the session no later than 24 hours before the session is to take place.
V. FEES AND PAYMENTS
In exchange for providing tutoring services, the Client will pay the Tutor a rate of $60 per class of 45 minutes. Payment for scheduled sessions is due in advance. Classes will not be given without prior payment (Please read my policies on payments).
VI. SCHEDULE
The Tutor will provide services to the student:
On an As-needed Basis: The Client will request tutoring services when required, and the Parties will decide on a date and time.
Scheduled Sessions: On a Fixed Schedule. Each week, the Tutor will meet with the student at the times below: ______________________________________________________________. Note: Most make-up lessons are on Saturdays.
VII. TERM
This Agreement will start with the 1st Session on __________________ and continue until canceled by either Party with 30 days’ notice.
VIII. LATE POLICY
If the Student is late to a scheduled session by more than 15 minutes, the session will be considered forfeited, and the Tutor is under no obligation to remain at the tutoring location or to remain online for remote sessions. If the Tutor arrives late to a scheduled session, the Client may choose to add the missed time to a future session at no additional cost, receive a partial refund, or receive a partial credit toward a future session.
IX. CANCELLATION POLICY & RESCHEDULING
If the Client wishes to cancel a scheduled tutoring session, the Client must provide the tutor with at least 24 hours’ prior notice. If the Client does not provide the required notice, the Client will be charged for the session whether or not the Student is present. The tutor will reschedule a lesson only for valid reasons (read my policies document) and only if the Tutor is notified within 24, but not less than 8-6 hours. However, if the Tutor is not notified with enough time, the class will still be charged, and the Tutor will not be obligated to reschedule. Please note: Any prepaid sessions will be rescheduled within the month if canceled. A session will be forfeited when the client fails to attend the rescheduled class. Sessions missed in May will be rescheduled during the summer at a convenient time for both parties. Every effort will be made to ensure that your student will get the services agreed upon and paid for.
X. NO WARRANTY
The Tutor makes no guarantees that tutoring services will result in any improvement in the Student’s grades or exam scores. The Tutor will make a good faith effort in accordance with industry standards.
XI. GOVERNING LAW
This Agreement is governed under the laws located in the state of Texas.
XII. ADDITIONAL TERMS & CONDITIONS
Unexcused and frequently missed lessons will not be credited, will not be rescheduled, and will make your slotted time available to other students and ultimately may cause my services to be terminated and nullify this contract.

LESSONS & PAYMENTS: Specific subject tutoring (Phonological Awareness, Phonics, Language Arts, Reading, Math, Spanish, Test preparation, or Homework help) is provided on a weekly basis in time slots of 45 minutes. The students are provided with the tutor’s undivided attention, using the very best in pedagogy and resources to engage your child in meaningful activities that promote learning/mastery of needed concepts/skills and build a solid foundation of knowledge upon which he/she will go on to the next level. Your tuition also covers the time devoted to administrative needs, planning, grading, printing, emailing, academic research and development, etc. Please know that payment for lessons is due in advance at the beginning of the month with the total due depending on the number of hours agreed in the month. I am sorry for the inconvenience, but classes will not be given without prior payment. Late fee charge of $15 will be added after the 15th day.
§ ATTENDANCE/CANCELATION/RESCHEDULING: Please read carefully, I have reserved your child’s time scheduled exclusively for his/her use. Please value this time by coming on time. I am always happy to accommodate your need to reschedule a lesson because of valid reasons such as doctor’s visits, school events, family vacations etc. If your child is not able to attend due to illness or unplanned emergencies, rescheduling is a possibility if I am notified within 24, but not less than 8-6 hours. In such cases I will reschedule a make-up lesson for another time, usually on Saturdays. I always take into consideration life’s last minute, unexpected situations which are out of our control, and I will try my best to accommodate as soon as possible and as my schedule permits. However, If I am not notified with enough time the class will still be charged and I will not be obligated to reschedule. Please consider that this is my occupation and the only means of income to pay my bills and provide for the needs of my family.

Every effort will be made to ensure that your student will get the services agreed upon and pay for them. SICKNESS: Please be kind to me, my family and other students by not bringing your child while having a fever within 24 hrs. or a persistent cough. I will gladly reschedule you class if you cancel due to health issues (just notify me with enough time)
INITIAL/FINAL ASSESSMENTS : I highly recommend a grade assessment at the beginning/or end of the school year and definitely before I begin tutoring. However, this is optional. The cost is $75.00. This assessment allows me to identify weaknesses and strengths as well as overall readiness for the student's present or future grade level.
1. This placement test can help us determine whether your child is ready for the next grade level. The test is not exhaustive, but it will give us a clear starting point. In making any final placement decision I will also use common sense and my personal teaching experience.
2. The student should work independently, no help from parents or tutors, without the use of a calculator or access to computers. Write every question in a separate sheet of paper. Use pencils.
3. It is not necessary to time the test, but most students will finish in one to two hours.
CANCELLATION OF SERVICES: In some circumstances My tutoring 101 reserves the right to cancel or deny services, such as:
Frequent cancellations or 4 consecutive last minute cancellations.
Unpaid balance.
Unproductive sessions (in spite of all my efforts).
Please notify me of your desire to cancel our working agreement 2 weeks prior to your paid class. Many times our needs and circumstances change and we must move on to new settings or endeavors. I totally understand.
HEALTH/COVID-19 PRACTICES/PROCEDURES TO AVOID INFECTIONS AND ENSURE THE WELL BEING OF ALL MY STUDENTS AND THEIR FAMILIES
1. NOTIFY ME IMMDEDIATELY IF YOU OR YOUR CHILD HAVE BEEN IN CONTACT WITH AN INFECTED PERSON.
2. DO NOT COME TO CLASS IF YOU HAVE ANY SUSPICIONS OF INFECTION (ANY DISEASE).
3. PLEASE DO NOT COME TO CLASS IF YOU HAVE ANY SYMPTOMS OF ANY DISEASE, SPECIALLY COVID-19. I WILL GLADLY RESCHEDULE YOUR IN-PERSON CLASSES OR PROVIDE ONLINE INSTRUCTION.
4. BEFORE CLASS, PREPARE YOUR CHILD WITH HAND SANITIZER OF YOUR CHOICE. (I HAVE ONE IN THE CLASSROOM IF YOU NEED IT). HAVE YOUR CHILD WEAR A MASK OR A SHIELD (OR BOTH).
5. PLEASE USE ONLY THE GARAGE DOOR TO ACCESS/ EXIT THE CLASSROOM. STUDENTS ARE ONLY ALLOWED IN THE CLASSROOM AND THE BATHROOM.
6. BEFORE AND AFTER CLASS EVERY STUDENT MOST WIPE THE MOUSE AND THE KEYBOARD AS WELL AS THEIR DESK AREA.
7. YOUR CHILD MUST BE SEATED AND REMAIN ON THE STUDENT SIDE OF THE PROTECTIVE PEXIGLASS SCREEN.
8. FOR THE TIME BEING, PLEASE AVOID CONTACT WITH ANY OTHER MEMBERS OF MY FAMILY IF THEY HAPPEN TO COME BY.
NOTE: I DESINFECT MY CLASSROOM DAILY DIFUSING HYDROGEN PEROXIDE AND ESSENTIAL OILS DURING CLASS. I SPRAY THE ROOM WITH THIEVES AND PURIFICATION ESSENTIAL OILS. PLEASE INFORME OF ANY ALLERGIES TO PEPPERMINT, LAVANDER, CINNAMON, OR ANY OTHER PLANT. BATHROOM AND CLASSROOM ARE DESINFECTED DAILY WITH A STEAM MOP MIXING HYDROGEN PEROXIDE IN THE WATER.
THESE RULES MUST BE OBSERVED AT ALL TIMES BY ALL OF US TO CARE FOR EACH OTHER. THANK YOU FOR YOUR COOPERATION. I VERY MUCH ENJOY TEACHING PLEASE HELP ME TO STAY HEALTHY.
